On Monday, April 29, in a stunning display of judicial activism, U.S. District Judge Michael McShane issued an order that prevented the Protect Life Rule from going into effect May 3, 2019. The proposed rule would ensure that taxpayer money designated for family planning would not fund abortion providers. It was disgraceful to see Governor Brown and Attorney General Rosenblum appear with the director of Columbia Willamette Planned Parenthood to celebrate this decision.

Throughout his decision, Judge McShane cites statements by Planned Parenthood and their pro-abortion allies and takes them at face value. In his opinion, he stated that the rules would cause a reduction in contraceptive services, breast cancer detection, cancer screenings, and STD testing.   Ironically, these services are already declining at Planned Parenthood facilities, according to their own reports. The idea that millions of federal family planning dollars would go unspent when there are thousands of federally qualified health centers (FQHCs) across the U.S. is ludicrous.

The judge goes even further to expose his bias by adopting  the vernacular of the abortion movement. He addresses the rules as the so-called “gag” rule, which is nothing of the sort. The rule still allows for referrals to providers who perform abortions. After decades of abortion promotion in the guise of healthcare, these rules seek to reflect the original intent of the legislation:  to exclude abortion from family planning programs. Even in his decision, the judge displayed a paternalistic view that because a woman is low-income and pregnant she is unable to seek out providers on her own.

Title X was never meant to include abortion which ends the life of an existing family member.  Family planning is planning if and when you will add a family member. The fact that Planned Parenthood, which is the largest abortion provider in the U.S., has been able to hijack this program to subsidize its profits is shameful.  

 

President Trump and Secretary of Health and Human Services Azar are to be commended for this common sense rule returning Title X to its true purpose.
