The abortion businesses did not challenge the late-term ban, but did challenge the other two parts of the bill.
The law was upheld by the 5th U.S. Circuit Court of Appeals and then was temporarily blocked by Supreme Court Justices Kennedy, Kagan, Ginsburg, Breyer, and Sotomayor. The Court’s decision could come amid next year’s presidential election.
The coalition of abortion companies argue that the pro-life law presents an “undue burden” on women seeking abortions. National Right to Life President Carol Tobias disputes that saying, “The abortion industry doesn’t like these laws because abortion clinics would be forced to spend money to meet basic health and safety standards. For them, this isn’t about ‘protecting’ the women they purport to help, it’s about preserving their cash flow.”
